Phoenix Logic is a technology platform that helps commercial property managers identify, document, and file insurance claims for property damage. The Service includes a web-based dashboard, automated claim analysis, carrier communication tools, and an SMS/MMS messaging program for collecting claim documentation from tenants.

2. Eligibility and Accounts

You must be at least 18 years old and have the legal authority to enter into these Terms. If you create an account on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms. You are responsible for maintaining the security of your account credentials.

3. Acceptable Use

You agree not to:

  • Submit fraudulent claims, false documentation, or misrepresent damage
  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service

4. SMS Messaging Terms

By texting our phone number or opting in through our platform, you consent to receive automated SMS and MMS messages from Phoenix Logic related to your insurance claim. This includes messages requesting information, confirming receipt of documents, and providing claim status updates.

  • Message frequency varies based on your claim activity.
  • Message and data rates may apply. Contact your carrier for details.
  • Consent to receive text messages is not a condition of purchasing any goods or services.
  • Service is available on all major US wireless carriers.

You may opt out of SMS messages at any time by replying STOP to any message. Other recognized opt-out keywords include: STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT. For help, reply HELP or email support@phoenixlogic.io.

5. Intellectual Property

All content, software, trademarks, and materials on the Phoenix Logic platform are owned by Phoenix Logic Inc. and protected by applicable intellectual property laws. You retain ownership of any documents, photographs, or information you submit through the Service. By submitting content, you grant us a limited license to use it for the purpose of providing the Service.

6. Fees and Payment

Certain features of the Service may require payment. Fees, billing terms, and pricing are presented at the time of purchase or subscription. All fees are non-refundable unless otherwise stated. We reserve the right to change our pricing with reasonable notice.

7. Disclaimer of Warranties

Phoenix Logic does not guarantee claim approval, settlement amounts, or insurance carrier decisions. We are not an insurance company, broker, or adjuster. We do not provide legal, financial, or insurance advice.

8. Limitation of Liability

To the maximum extent permitted by law, Phoenix Logic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Utah.

11. Modifications

We may update these Terms at any time by posting the revised version on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via the platform or email.

  • Service providers: cloud hosting, email delivery, payment processing, and analytics providers that help us operate the platform, under contractual obligations to protect your data
  • Legal compliance: when required by law, regulation, legal process, or governmental request

4. Data Storage and Security

Your data is stored using industry-standard security measures. Documents and photographs are stored in encrypted cloud storage. Database connections use SSL/TLS encryption. Access to data is restricted on a need-to-know basis and protected by role-based access controls. While we implement reasonable safeguards, no method of electronic storage is 100% secure.

5. Data Retention

We retain your data for as long as your account is active or as needed to provide the Service. Claim data is retained as long as necessary to fulfill legal and business obligations. SMS consent records are retained for a minimum of 5 years per TCPA requirements. You may request deletion of your data by contacting support@phoenixlogic.io.

6. Your Rights

Depending on your jurisdiction, you may have the right to:

How to get started:

  1. Text any message to our number (provided by your property manager)
  2. Reply with your property address when prompted
  3. Follow the guided steps to describe the damage and submit photos
